Trust Insight - Privacy Policy

The Privacy Policy described here seeks to strengthen Trust Insight’s commitment to the privacy of Users while using our website, as well as to prioritize the principle of transparency.

By means of this document, Trust Insight undertakes to disclose and clarify how the personal data of its Users is processed, so that they know what information is collected, used, stored, disposed of or disclosed to third parties.

Important definitions

a – “Trust Insight”: TRUST INSIGHT LTDA, registered with the CNPJ/MF under no. 37.671.002/0001-12, and within the scope of this policy, and for the purposes of the LGPD, “controller”;

b – “Site”: environment that provides Trust Insight functionality;

c – “User”: natural or legal person who uses the site, especially those defined as specialists.

d – “Privacy Policy”: document by which Trust Insight clarifies in detail the processing of Users’ personal data, in compliance with current legislation, especially in accordance with the provisions of the General Data Protection Act;

e – “LGPD”: General Data Protection Law or Law no. 13.709/18;

f – “Personal data”: any information relating to natural persons which identifies them, or which, used in combination with other information processed, identifies an individual;

g – “Data subject”: natural person to whom the personal data being processed refer;

h – “Processing of personal data”: processing of personal data is considered to be the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, dissemination or extraction of data on natural persons;

i – “Controller”: a natural or legal person, whether governed by public or private law, who is responsible for decisions regarding the processing of personal data;

j – “Operator”: a natural or legal person, whether governed by public or private law, who processes personal data on behalf of the controller;

k – “Access logs”: the set of information relating to the date and time of use of a given Internet application from a given IP address;

l – “Purpose”: what Trust Insight aims to achieve by processing personal data;

m – “Necessity”: reason why the processing of personal data by Trust Insight is justified in order to achieve the intended purpose;

n – “Consent”: free, informed and unequivocal authorization (leaving no doubt) by which the user agrees to the processing of their personal data for a previously stipulated purpose. Once consent has been granted, the user can revoke it at any time. However, it should be noted that revoking consent does not invalidate the processing carried out previously.

To whom this Privacy Policy applies

This Privacy Policy applies to all those who use the Trust Insight website, as well as those who have their personal data processed by Trust Insight in any way. It does not apply to third-party websites, even if the user accesses them via links on the Trust Insight website. Use of the site by the User implies acceptance of this Privacy Policy.

Trust Insight, through the website, collects and uses the following personal data for the provision of its services

Trust Insight, through a form filled in by the User on the website, collects and stores: (i) bank account, (ii) CPF, (iii) date of birth, (iv) e-mail, (v) address, (vi) name, (vii) nationality, (viii) ID and date of issue, (ix) telephone number and (x) PIS.

Users can use the site’s features without having their data collected, automatically or otherwise. However, in order for Trust Insight to provide its services, the User must fill in the participation form and agree to this Privacy Policy and the Terms of Use.

Sharing data with third parties

Trust Insight shares Users’ personal data in cases where the sharing is necessary for compliance with applicable legislation or in the face of a request from public or governmental authorities.

In addition, Trust Insight shares the personal data collected from Users, by filling in the participation form, with partner companies (operators) for the regular provision of the services offered, with the specific aim of presenting the profile of the specialist to the client, issuing the Self-Payment Receipt (RPA) and, subsequently, to make payments to the specialists after their participation in the meetings, with the sole aim of fulfilling these purposes based on the fulfillment of a legal obligation and the execution of a contract after the User has joined (art. 7, items II and V, of the LGPD).

The site may include links to third-party sites, plug-ins or applications. Clicking on these links or enabling such connections may allow third parties to collect or share User data. Trust Insight is not responsible for the Privacy Policy of these third-party websites, so the User should make sure to read the specific Privacy Policy of each website visited.

Personal data retention time

The personal data collected or processed by the Trust Insight website will be stored for the duration of the contract between the company and the User (art. 7, point V of the LGPD). After the end of the contract, the User’s information will only be stored for the purpose of fulfilling the hypotheses provided for by law, as well as due to legitimate interest or consent, with the User having the option of demonstrating their opposition at any time.

If the right to object to processing is exercised, the personal data processed by Trust Insight will be deleted, with the exception of cases in which processing is still necessary due to other hypotheses provided for in Article 7 of the LGPD.

In addition, once the processing of personal data has ended, the data will be deleted, with the exception of the cases of retention provided for in art. 16 of the LGPD, as follows:

I – compliance with a legal or regulatory obligation by the controlling shareholder:

II – study by a research body, guaranteeing, whenever possible, the anonymization of personal data;

III – transfer to a third party, provided that the data processing requirements set out in this Law are complied with; or

IV – exclusive use by the controller, with no access by third parties, and provided that the data is anonymized.

Rights of personal data subjects

Users have the right to request information from Trust Insight regarding the processing of their personal data, as provided for in the General Data Protection Act: a – Confirmation of the existence of processing; b – Access to data; c – Correction of incomplete, inaccurate or outdated data; d – Anonymization, blocking or deletion of unnecessary, excessive data or data processed in non-compliance with the LGPD; e – Portability of data to another service or product provider, upon express request, in accordance with the regulations of the national authority, observing commercial and industrial secrets; f – Deletion of personal data processed with the consent of the holder – the personal data of the holders will be deleted after the purpose has been fulfilled, except in certain cases: g – Information on public and private entities with which the controller has made shared use of data; h – Information on the possibility of not providing consent and on the consequences of refusing; i – Revocation of consent; j – Review of automated decision. Personal data security

In order to protect information, Trust Insight uses functional technical security measures, as well as restricting access to User data by means of a login and password and encryption, both of which are adequate to guarantee the security of the personal data under its control. All security controls and operating records are periodically reviewed to monitor and prevent threats on the Internet.

Furthermore, in addition to having a data governance and privacy program in place, the company keeps records of the personal data processing operations it carries out within its environment, in strict compliance with the provisions of art. 37 of the LGPD.

Legislation and jurisdiction

This Privacy Policy shall be governed, interpreted and applied in accordance with the Laws of the Federative Republic of Brazil, regardless of the Laws of other states or countries, and the jurisdiction of the District of the Capital of São Paulo shall be competent to settle any doubts arising from this document.

Modification of the Privacy Policy

Trust Insight may modify, alter or replace the site’s Privacy Policy at any time. If the User does not agree with the changes, they may revoke their consent in accordance with the law. This privacy policy was updated and revised on August 31, 2023.
